Terms of Service

These Terms of Service govern your use of the XM Promo Services platform, operated by XM Promo Services LLC, 30 N Gould St Ste R, Sheridan, WY 82801, United States ("XM Promo Services", "we", "us").

1. The service

XM Promo Services generates advertising creative using artificial intelligence, including synthetic presenters, synthetic voices, generated scripts and generated video. Output quality, availability and capabilities depend on the third-party AI providers configured for the platform and may change.

2. Accounts

You must provide accurate registration details and keep your credentials secure. You are responsible for activity under your account. Accounts are for a single organisation and may not be shared to circumvent plan limits.

3. Credits

• Credits are the internal unit used to pay for generations and have no cash value.
• The signup bonus is granted once per user account.
• Credit cost per generation is shown before you confirm a generation.
• Credits are reserved when a generation starts and released if the generation fails before a billable render is produced.
• Attempting to obtain credits through duplicate accounts, automation or other abuse may result in suspension.

4. Subscriptions and billing

Subscriptions renew automatically for the billing period you selected until cancelled. Cancellation takes effect according to the terms displayed at the time of cancellation. Payments are processed by Stripe; we do not store card details.

5. Your content and your responsibilities

You retain rights in the product information and assets you upload, and you confirm you have the rights to use them. You are solely responsible for ensuring your advertising complies with applicable law, advertising platform policies, intellectual property and trademark rights, product claim rules and consumer protection law.

6. Acceptable use

Use of the platform is subject to our Acceptable Use Policy. We may refuse, block or remove generations that violate it.

7. Availability and providers

The platform depends on third-party providers. We do not guarantee uninterrupted availability, specific generation times, or that any particular provider or model will remain available.

8. Termination

You may stop using the service at any time. We may suspend or terminate accounts that breach these terms. We do not delete your generated content on cancellation of a subscription; account deletion is handled through your profile settings.

9. Disclaimers and liability

The service is provided on an "as is" basis to the maximum extent permitted by law. We are not liable for advertising performance, platform rejections, or losses arising from your use of generated creative.
